They discuss Justice Thomas's analysis of the landmark First Amendment case, New York Times v. Sullivan, in a recent denial of certiorari to Kathrine McKee. Erik shares his thoughts on Justice Thomas's interpretation of Sullivan and how a reconsideration of the case could affect defamation law.
