    Présentation de la chaire

    L'intitulé de la chaire État social et mondialisation : analyse juridique des solidarités – est un peu long, car il désigne à la fois un objet et une méthode. Son objet ne se laissant pas enfermer dans les frontières sûres et reconnues d'une « branche » du droit, il faut pour le comprendre, envisager ce dernier comme un outil d'analyse des sociétés et non pas seulement comme un système établi de règles. Cette analyse doit adopter une focale assez large pour situer l'État social dans l'histoire et la géographie des solidarités humaines et considérer à la fois son puissant impact sur les liens sociaux et sa déstabilisation par le processus de globalisation.

    Ce terme de « globalisation » entretient toutefois la confusion entre deux types de phénomènes différents. D'une part des phénomènes structurels, telles l'abolition des distances physiques dans la circulation des signes entre les hommes, ou leur commune exposition aux risques sanitaires ou écologiques engendrés par le développement technique. D'autre part la libre circulation des capitaux et des marchandises, qui est un phénomène conjoncturel, procédant de choix politiques réversibles qui conduisent à la surexploitation de ressources physiques non renouvelables.

    C'est pourquoi à cette notion acritique de globalisation il faut opposer le concept de mondialisation. Au sens à la fois étymologique (où monde s'oppose à immonde) et juridique (où le mundus symbolisait en droit romain l'unité de la cité), mondialiser consiste à rendre un lieu humainement vivable et habitable. Ce qui aujourd'hui requiert d'adapter les formes juridiques d'organisation du travail héritées du monde industriel aux risques et aux chances de la révolution numérique ; et de concevoir un ordre juridique international qui interdise d'user de l'ouverture des frontières du commerce pour échapper aux devoirs de solidarité face aux risques sociaux et écologiques.

    Biographie

    Docteur d'État en droit (Bordeaux, 1979), agrégé des Facultés de droit (1980), docteur h.c. des universités de Louvain-la-Neuve, Aristote de Thessalonique, Liège et Buenos Aires, Alain Supiot est professeur émérite du Collège de France et membre correspondant de la British Academy (2015). Au cours de sa carrière, il a été successivement professeur à l'université de Poitiers puis de Nantes (UMR-CNRS 6028), et membre senior de l'Institut universitaire de France (2001), avant d'être élu au Collège de France en 2012 – où il a occupé jusqu'en 2019 la chaire État social et mondialisation : analyse juridique des solidarités. Il a présidé de 1998 à 2000 le Conseil national du développement des sciences humaines et sociales, et a été membre, de 2016 à 2018, de la Commission mondiale sur l'avenir du travail. Au cours de sa carrière, il a passé plusieurs années de recherche à l'étranger (1981 : Institute of Industrial Relations de Berkeley ; 1989/1990 : institut universitaire européen de Florence ; 1997/1998 : Wissenschaftskolleg zu Berlin). À Nantes, il a fondé en 1995 la Maison des Sciences de l'Homme Ange-Guépin, puis en 2008 l'Institut d'études avancées, qui accueille conjointement en résidence scientifique des savants des pays du « Sud » et du « Nord ».

    Ses travaux se sont principalement déployés sur deux terrains complémentaires : le droit social et la théorie du droit.
