Jim Santelle joins the show to talk legal issues! The central legal concept that had John and Gordy so wound up is the Non-Delegation Doctrine, which is basically the Supreme Court's way of saying, "Hey, stick to your lane, buddy!" The Constitution clearly gives Congress (Article I) the power to do boring stuff like tax people and manage commerce, but the Non-Delegation Doctrine says Congress is not allowed to outsource this job to the President. When the President decided to slap massive tariffs on everything, he was essentially trying to be the CEO and the Board of Directors, which is a big constitutional no-no. The entire Supreme Court argument was essentially a three-hour constitutional time-out, asking whether Congress gave the President a blank check, or, in this case, a vague emergency law (the IEEPA) that he tried to use as a legal hall pass. Fascist Fiasco (Hour 1)
To kick off the first hour, we had Gordy's exciting new, enormous TV—so enormous it was apparently giving him brain cell-scrambling "radiation" and mesmerizing him! John hilariously calls out Gordy, suggesting the only reason people buy those big screens is because they're "addicted." The comedy continued as John gently mocked Gordy's previous TV, claiming it wasn't even "1080p" (the horror!) and was "not real clear." The guys then had a moment of shared reality, reminiscing about the sheer heaviness of hauling those old sets. After a quick weather check (cloudy and a chilly 29 degrees!), the show took a sharp turn into politics, specifically fascism, to give the audience a "little lesson." The main takeaway? John is utterly baffled by the "MAGA community" being convinced that socialism is fascism. The segment was punctuated by a ridiculous-sounding clip of a right-wing media host equating immigration to fascism, leading John to deadpan, "I didn't know Obama was a fascist until I saw that today." John then provided a quick history lesson, trying to drill home the point that fascism (Musssolini) and Nazism (Hitler) were fundamentally ANTI-socialist and ANTI-communist. He pointed out the irony that the same folks who crushed labor unions and privatized industries (the fascists) are now being championed, while those on the left are being called terrorists for fighting fascism. The hour finished on a high note of silliness as John began to struggle to articulate his thoughts, realizing it was because Todd was bringing donuts into the studio, and John was officially done focusing until he got some sugar.
